By downloading, installing, accessing, or using the Alabama EMS Protocol Reference mobile application ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately discontinue use of the App and delete it from your device.
These terms constitute a legally binding agreement between you (the user) and the developer of this App.
2. NO AFFILIATION WITH STATE OF ALABAMA
This App is an independent, unofficial third-party reference tool created by an individual developer. This App is NOT:
- Affiliated with the State of Alabama
- Endorsed by the Alabama Department of Public Health
- Sponsored by the Alabama Office of EMS
- An official state application
The protocol content displayed in this App is sourced from publicly available documents provided by the Alabama Office of EMS, free of charge. The developer is not employed by or acting on behalf of any state agency.
3. MEDICAL DISCLAIMER
THIS APP IS FOR REFERENCE PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE.
This application provides access to EMS protocols for informational and reference purposes only. The information contained in this App is not intended to be a substitute for professional medical judgment, advice, diagnosis, or treatment.
Always seek the advice of qualified medical professionals with any questions you may have regarding medical conditions or patient care. Never disregard professional medical advice or delay in seeking it because of something you have read in this App.
The developer is not a medical professional and does not provide medical advice. Any reliance you place on the information in this App is strictly at your own risk.
4. INTENDED USE AND USER RESPONSIBILITIES
This App is intended solely for use by certified and licensed Emergency Medical Services (EMS) professionals who have received proper training and authorization to use these protocols.
By using this App, you represent and warrant that:
- You will verify all protocol information before application in patient care
- You will comply with all applicable laws, regulations, and medical director orders
- You understand that this App is a reference tool and does not replace proper training, certification, or medical oversight
- You will not rely on this App for critical medical decisions
Users are solely responsible for ensuring they are operating within their scope of practice and following their agency's policies, procedures, and medical direction.
5. NO WARRANTY - ACCURACY OF INFORMATION
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
While the developer strives to keep the information in this App accurate and up to date, no representations or warranties of any kind, express or implied, are made about the completeness, accuracy, reliability, suitability, or availability of the information contained in the App.
The developer specifically disclaims all warranties, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of content
- Uninterrupted or error-free operation
Medical protocols may change without notice. Users are solely responsible for verifying protocol information and ensuring they are using the most current version of protocols as authorized by their medical director and agency.
6. OFFLINE FUNCTIONALITY AND UPDATES
This App is designed to function completely offline. All protocol information is stored locally on your device and reflects the 2025 Alabama EMS protocols available at the time of the app's release.
Protocol Updates:
The developer may release updates to reflect new Alabama EMS protocols at the sole discretion of the developer. However, the developer makes NO GUARANTEE OR PROMISE regarding:
- Whether future updates will be provided
- The frequency or timing of any updates
- The availability of updates when Alabama EMS protocols change
Users are solely responsible for:
- Verifying they are using current protocols as authorized by their medical director and agency
- Checking the Alabama Office of EMS website (https://www.alabamapublichealth.gov/ems/rules-and-protocols.html) for the latest official protocol versions
- Understanding that this App may contain outdated information if Alabama EMS updates their protocols and the developer has not released an update
This App provides the 2025 Alabama EMS Patient Care Protocols. As protocols change over time, users must verify they are following the most current versions through official channels.
7. EXTERNAL RESOURCES AND THIRD-PARTY WEBSITES
The App includes a Resources section with links to external EMS organizations, educational resources, and professional websites. When you click these links, you will leave the App and navigate to external websites in your device's web browser.
IMPORTANT DISCLAIMERS REGARDING EXTERNAL RESOURCES:
Accuracy and Availability:
- The developer is not responsible for the accuracy, completeness, reliability, or availability of any external websites or their content
- External websites may change, become unavailable, or go offline at any time without notice
- The developer has no control over external websites and cannot fix or address issues with those sites
- The inclusion of any link does not imply endorsement of the external website or its content
Privacy and Data Collection:
- External websites have their own privacy policies that govern how they collect, use, and protect your data
- The developer does not control and is not responsible for the privacy practices of external websites
- When you visit external websites, their privacy policies apply, not this App's privacy policy
- The developer does not collect any data about which external links you click or which websites you visit
- The developer does not track, monitor, or receive any information about your interactions with external resources
You are strongly encouraged to:

8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
In no event shall the developer, Alabama EMS Protocol Reference, or any content providers be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in any way connected with:
- The use or inability to use this App
- Any information, content, or protocols contained within the App
- Any errors, omissions, or inaccuracies in the content
- Any decisions made or actions taken based on information in the App
- Any patient care or medical outcomes
- Any loss of data or interruption of service
- Any unauthorized access to your device
- The content, accuracy, availability, or privacy practices of any external websites or resources
- Any actions taken or data collected by external websites you access through the App's Resources section
This limitation applies even if the developer has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING IT.
9. UPDATES AND MODIFICATIONS TO TERMS
The developer reserves the right to modify these Terms of Service at any time. Continued use of the App following any changes constitutes acceptance of those changes.

10. PRIVACY AND DATA COLLECTION
This App is designed with privacy in mind and operates completely offline for its core functionality.
The App does not:
- Collect any personal information
- Track your usage or behavior within the App
- Transmit any data over the internet
- Store data on external servers
- Share information with third parties
- Require an account or registration
- Track which external resources you click or visit
All core functionality is performed locally on your device. Any contacts or settings you create are stored only on your device in the app's local database.
Data Backup and Restoration:
- Your custom contacts and settings are automatically included in your device's iCloud Backup if you have enabled iCloud backup in your device settings
- You can export your custom contacts as CSV or vCard files for manual backup, sharing, or migration
- When you delete the App, all local data is permanently deleted from your device
- If you restore your device from an iCloud Backup, your custom contacts and settings will be restored
- Simply reinstalling the App after deletion will NOT restore your data unless you perform a full device restore from iCloud Backup or import from a previously exported file
- You are responsible for ensuring your custom contacts are backed up through your device's iCloud Backup or by exporting them before uninstalling the App
External Resources: When you click links in the Resources section, you leave the App and access external websites in your browser. The developer does not track, monitor, or collect any information about which links you click or which external websites you visit. Those external websites may have their own data collection and privacy practices governed by their privacy policies, not this App's privacy policy.

11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the developer, Alabama EMS Protocol Reference, and any content providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms of Service
- Your violation of any rights of another party
- Any medical or patient care decisions made using information from the App
- Any harm to patients or third parties resulting from your use of the App
- Your use of or reliance on any external websites accessed through the App's Resources section
This indemnification obligation will survive termination of these Terms of Service and your use of the App.
12. INTELLECTUAL PROPERTY
Application Code and Design:
The application code, software design, user interface, and functionality of this App are the property of the developer and are protected by copyright, trademark, and other intellectual property laws.
Protocol Content:
The Alabama EMS Patient Care Protocols displayed within this App are owned and administered by the Alabama Office of EMS and the Alabama Department of Public Health. These protocols are publicly available content that can be downloaded from the Alabama Office of EMS website at https://www.alabamapublichealth.gov/ems/rules-and-protocols.html.
The developer does not claim ownership of the protocol content. The protocols are included in this App solely to provide EMS professionals with a convenient reference tool.
License Grant:
You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose only. You may not:
- Copy, modify, or distribute the App's code or design
- Reverse engineer or decompile the App
- Remove any copyright or proprietary notices
- Use the App for any commercial purpose without permission
The publicly available protocol content may be accessed directly from the Alabama Office of EMS in accordance with their terms and policies.
13. TERMINATION
The developer reserves the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these terms.
You may terminate this agreement at any time by deleting the App from your device.
Upon termination, all rights granted to you under these terms will immediately cease.
14. SEVERABILITY
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT
These Terms of Service constitute the entire agreement between you and the developer regarding the use of this App and supersede any prior agreements or understandings.
16. NO WAIVER
The developer's failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
